Section 01Agreement

These Terms of Service (“Terms”) are a contract between you and [COMPANY NAME] (“Cold Streak,” “we,” “us”) covering the Cold Streak iOS application, this website, and everything in them (together, the “Service”). By downloading, opening, or using the Service, you agree to these Terms. If you don’t agree, don’t use it.

Our Privacy Policy is part of this agreement and explains what happens to your data.

Section 02You must be 18

The Service is for adults only. You must be at least 18 years old — or older, if your jurisdiction sets a higher age for accessing gambling-related content or for entering a contract — and you represent that you are. We will terminate accounts we learn belong to minors and delete the associated data.

Section 03What Cold Streak is

Cold Streak is a self-guided habit, tracking, and motivation app for people who want to stop or reduce sports betting. It gives you: a money-kept counter derived from figures you enter, streak tracking, an urge-management flow, scheduled high-risk windows, a 90-day educational program, an anonymous community, an optional AI chat feature, and optional device-level blocking. That is the whole of what we provide.

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.

Section 04Not medical advice, not treatment

Cold Streak is not a medical device, a healthcare service, or a treatment program. We do not provide medical, psychiatric, psychological, or counseling services. Nothing in the app diagnoses a gambling disorder or any other condition, and nothing in it is a substitute for care from a licensed professional.

The onboarding questionnaire and any score, band, or percentage it produces are self-assessment prompts, not a clinical assessment and not a diagnosis. The 90-day program is educational content, not therapy. We make no claim, promise, or guarantee that using Cold Streak will stop you gambling, reduce harm, save you money, or produce any particular result.

If you are struggling, please talk to a professional. Free, confidential help is available 24/7 from the National Problem Gambling Helpline at 1-800-GAMBLER (1-800-426-2537). If you are thinking about suicide or self-harm, call or text 988. If someone is in immediate danger, call 911. Do not delay contacting emergency services because you are using this app.

Section 05Not financial advice

The money-kept counter, projections, and milestones are estimates calculated from figures you tell us — principally your stated average weekly betting spend. They are motivational, not accounting. They are not a bank balance, not audited, and not a statement of your actual finances. We are not financial advisers and nothing in the Service is investment, tax, or financial advice.

Section 06Subscriptions, auto-renewal & cancellation

Full access to Cold Streak requires a paid subscription, purchased as an in-app purchase and billed through your Apple ID. We never see or handle your payment details.

Plans and price

Current plans are [$12.99] per month and [$44.99] per year, in USD. Prices in other regions are set by Apple’s pricing tiers and may differ. The exact price, currency, and billing period are shown to you on the purchase screen before you confirm, and that display governs.

Auto-renewal — read this part

• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription renews automatically at the same price and period unless you cancel.
• To avoid being charged, you must cancel at least 24 hours before the end of the current period.
• Apple charges the renewal within 24 hours before the current period ends.
• You can manage and cancel in iPhone Settings → [your name] → Subscriptions.
• Cancelling stops future renewals. You keep access until the end of the period you already paid for.
• Deleting the app does not cancel your subscription. You must cancel through Apple.

Step-by-step cancellation instructions are on our support page. We will not make you email us, call anyone, or click through a retention flow to cancel.

Price changes

If we change the price of a plan you are on, Apple will notify you and, where required, ask for your consent before the new price takes effect. If you don’t consent, the subscription will not renew at the new price.

Restoring purchases

Reinstalled the app or got a new phone? Use Settings → Subscription → Restore purchases in the app, signed in with the same Apple ID you bought with.

Section 07Refunds

Purchases are made through Apple, so Apple handles refunds, under Apple’s Media Services Terms. Request one at reportaproblem.apple.com. We cannot issue a refund for an Apple purchase directly, and we do not prorate unused time. Consumer rights that apply in your country are not affected by this section. If Apple declines and you think something genuinely went wrong, email us anyway at support@coldstreak.app — we will do what we can.

Section 08Community rules

The community exists so people at day 2 can read people at day 400. Keep it usable:

• No promoting gambling. No picks, tips, lines, odds, parlay slips, results bragging, sportsbook referral or affiliate links, or promo codes.
• No shaming. Someone posting a relapse gets support or gets scrolled past. Not a lecture.
• No harassment, hate, threats, or targeting anyone.
• No doxxing — yours or anyone else’s. Don’t post real names, addresses, workplaces, or financial account details.
• No selling anything: no spam, no recruiting, no promotion of your own services or apps.
• No medical claims or telling someone to stop treatment or medication.
• No illegal content, and nothing that infringes someone else’s rights.

We may remove content, suspend, or permanently ban accounts for breaking these rules, or where we reasonably believe it is necessary to keep people safe. We aim to be fair; we do not promise a formal appeal process.

Section 09Your content

You keep ownership of what you post. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your posts within the Service, so the community can work, plus the right to keep moderation records. This license ends when you delete your content, except for copies already made by other users and copies we must retain for legal or safety reasons.

We will not use your posts in marketing without asking you first and getting your explicit consent — that includes screenshots, testimonials, and quotes on this website.

You are responsible for what you post, and you confirm you have the right to post it. Content from other members is theirs, not ours, and we do not endorse it. Everything in the community is peer opinion, not professional advice.

Section 10Blocking and AI features — honest limits

Blocking is not a wall. App and site blocking relies on Apple’s Screen Time framework. It can be disabled, worked around, or bypassed — by you, by using another device, by a browser we don’t cover, or by a betting operator changing its domains. It is friction that buys you time, and it is not a guarantee that you cannot place a bet. We do not warrant that any content will be blocked.

The AI corner man is software. Replies are generated by an AI model. They can be wrong, incomplete, or not right for your situation. It is not a counselor, sponsor, therapist, or crisis service, and it is not a substitute for a human. It will not give betting advice, odds, or picks. In a crisis, contact 1-800-GAMBLER, 988, or 911 — not the chat.

Notifications and check-ins may not arrive. Local notifications depend on iOS, your settings, battery state, and focus modes. Do not rely on a Game-Day Shield check-in as your only safeguard.

Section 11Acceptable use

You agree not to:

• reverse engineer, decompile, or attempt to extract the source of the Service, except where law says you may;
• scrape, crawl, or bulk-download community content;
• interfere with, overload, or attack our infrastructure;
• use the Service to promote gambling products or to solicit other members;
• share your account, or use someone else’s;
• use the Service where it would be unlawful.

Section 12Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT CALCULATIONS OR NOTIFICATIONS WILL BE ACCURATE OR TIMELY, OR THAT IT WILL PRODUCE ANY PARTICULAR OUTCOME.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer under mandatory local law.

Section 13Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR GAMBLING LOSSES, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) [USD 50].

Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence, or anything else that cannot be excluded by law.

Section 14Termination

You may stop using the Service at any time; cancel your subscription through Apple and erase your data from Settings → Privacy & Data. We may suspend or terminate your access if you materially breach these Terms, or if we discontinue the Service. If we discontinue it entirely we will give reasonable notice and, where you have paid for time you cannot use, work with Apple on a fair outcome. Sections 4, 5, 9, and 12–16 survive termination.

Section 15Governing law & disputes

These Terms are governed by the laws of [STATE / COUNTRY], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [VENUE], unless mandatory consumer law in your country of residence gives you the right to sue locally — which it may, and which we don’t contest.

Section 16Apple

These Terms are between you and [COMPANY NAME] only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund your purchase price; Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government restricted-parties list.

Section 17Changes & contact

We may update these Terms. If a change materially affects your rights we will tell you in the app before it takes effect, and the “last updated” date above will change. Continuing to use the Service after that means you accept the new Terms.

If any provision is unenforceable, the rest stays in force. Our not enforcing something isn’t a waiver. These Terms plus the Privacy Policy are the entire agreement between us.
